Frequently Asked Questions (FAQs)

  • Do I have to report internally first before filing a qui tam case? No legal requirement exists under the federal False Claims Act, but we can discuss the pros and cons of internal reporting while protecting you from retaliation.
  • How much can a whistleblower receive? In successful False Claims Act cases, whistleblowers may receive 15%–30% of the amount the government recovers. Awards vary based on many factors.
  • Will my identity stay confidential? Qui tam cases are filed under seal, giving the government time to investigate while your identity remains protected from the company. Options exist to possibly keep your name confidential.
  • What if I fear retaliation? Federal law prohibits retaliation against whistleblowers. We can discuss your protections and next steps if you’ve already experienced or fear adverse actions.
  • How long do I have to file a case? Generally, the longer of 6 years from the violation or 3 years after the government should have known about it (with a 10-year maximum in many cases). Timing matters — the sooner you act, the better.
  • What kind of evidence do I need? Specific, firsthand knowledge and supporting documents (emails, records, data, etc.) strengthen a case. We help you understand what’s useful without risking your safety.
  • Can I file anonymously? You can often start the process confidentially. Full anonymity has limits once a case proceeds, but strong protections are available.


Recent Whistleblower Successes Under the False Claims Act

Whistleblowers play a critical role in exposing fraud against the government. In recent years, their efforts have helped recover billions of dollars for taxpayers while holding companies accountable. Record-Breaking Results in Fiscal Year 2025:  The U.S. Department of Justice reported the highest single-year recoveries in False Claims Act history:

  • Over $6.8 billion in total settlements and judgments — the largest amount ever in one year.
  • Healthcare fraud accounted for more than $5.7 billion (about 83% of the total).
  • Whistleblowers filed a record 1,297 qui tam lawsuits (the highest number ever).
  • Qui tam cases generated over $5.3 billion of the recoveries.


Many of these successes came from cases involving Medicare Advantage plans, prescription drug pricing and kickbacks, medically unnecessary services, and other healthcare matters. Some of the largest recoveries occurred even when the government initially declined to intervene — showing that credible evidence from insiders can still drive strong results. These outcomes demonstrate that bringing forward credible information can lead to substantial recoveries and help protect federal programs and patients.


Important Note:  Whistleblower awards in successful cases typically range from 15% to 30% of the government’s recovery, though the exact amount depends on numerous factors. Past results do not guarantee future outcomes.
